These terms apply to all quotations, bookings and work carried out by Wirral Garden & Property. By accepting a quote or booking a job with us, you agree to these terms.
Quotes are valid for 14 days from the date of issue.
Our price is a single, all-inclusive figure covering the labour, materials and waste removal expressly stated in that quote — nothing more, nothing less.
Quotes are based on the information and images you provide and on what is reasonably visible.
We do not charge by the hour unless specifically agreed in writing.
To quote accurately we rely on the photographs and description you give us.
If the photographs or information provided are not accurate or representative of the actual job on arrival, the work will be re-priced appropriately before we begin, or — if agreement cannot be reached — the job may be cancelled.
We will always discuss any change with you before carrying out re-priced work.
Waste disposal is always itemised in your quote. If it is not itemised, it is not included.
Where included, all green waste is removed and disposed of responsibly under our Licensed Waste Carrier registration (CBDL629820).
Where not included, arisings will be left tidily on site (for example bagged or stacked) unless you arrange waste removal separately with us.
Jobs requiring materials require a deposit of up to 50% of the total job value, payable before materials are ordered or work begins. This secures your materials and your date.
During busy periods we may ask for a small deposit to secure your booking.
Deposits covering materials already purchased are non-refundable. Booking deposits are refundable if you cancel with reasonable notice before any materials or costs are incurred.
Payment is due upon completion of the work, unless other terms are agreed in writing.
We accept cash, bank transfer or card.
Larger jobs may be invoiced; invoices are due on the date stated.
We reserve the right to charge interest on overdue accounts at 8% above the Bank of England base rate, and to recover reasonable recovery costs.
Please ensure we have safe, clear access to the work area on the agreed date, including gates or keys, and somewhere to park nearby where required.
Please secure pets and tell us anything we should know — for example hidden pipes, cables, irrigation, soft ground or boundary matters.
We are not responsible for delays or additional costs caused by lack of access or unsafe conditions on arrival.
Any work identified on the day that falls outside the agreed quote will be quoted separately and only carried out with your approval.
Please give us as much notice as you can if you need to cancel or move your booking.
Your 14-day change-of-mind period. If you booked as a consumer (not a business) and we agreed it remotely or at your home — rather than at our premises — you have a legal right to change your mind and cancel within 14 days of booking, for a full refund of any deposit paid.
If you want us to start within those 14 days, just say so. You can still cancel, but you'll only pay for work already carried out and for any materials we've already bought or ordered specifically for your job (these may not be refundable).
After the 14 days have passed, or once the job is finished, the change-of-mind period no longer applies. Your other consumer rights (for example if work is faulty) are unaffected.
If we have to move your date because of weather or something outside our control, we'll offer you the earliest alternative.
Gardening involves living things and natural conditions. We cannot guarantee the survival, regrowth or future condition of plants, lawns, turf or seed, as these depend on weather, soil, watering and ongoing care after we leave.
Any aftercare advice we give is guidance only.
Japanese knotweed, horsetail/marestail, giant hogweed and similar invasive species are a specialist service. These are handled through a dedicated site assessment and treatment plan (an assessment fee applies), not a standard garden quote.
For any work involving digging, excavation or ground penetration, you are responsible for advising us of the location of underground services such as pipes, cables and drains. We take reasonable care but cannot accept liability for damage to unmarked or undisclosed services.
We are fully insured and carry public liability cover.
We are not liable for pre-existing defects, or for loss or damage that was not reasonably foreseeable or that arises from information you did not disclose.
Nothing in these terms limits our liability for death or personal injury caused by negligence, or for anything that cannot be excluded by law. Your statutory consumer rights are not affected.
We take before and after photographs of our work for our records and may use them — without showing your name, full address or identifying details — to promote our services. Tell us if you'd prefer we didn't.
We take pride in our work. If you're not satisfied, tell us within a reasonable time and we'll do our best to put it right. Contact Marcos on 07542 888 772 or marcos@gmx.co.uk.
We handle your personal information in line with UK GDPR and use it only to provide and improve our services. See our Privacy Policy for details.
These terms are governed by the law of England and Wales and subject to the exclusive jurisdiction of its courts.
